WOTUS Rule Released

On Wednesday, EPA released the final version of the “Waters of the United States” rule. Oregon Farm Bureau is in the process of reviewing the final rule to determine whether the agencies addressed the many substantive comments Oregon Farm Bureau submitted regarding the draft rule. Despite being told several times by the courts and Congress that their power is not limitless, EPA and the Corps sought to greatly expand their authority to regulate land uses in Oregon, including many that would significantly impact agriculture. This drastic overreach by the federal government would have infringed on both state regulatory authority and private property rights within Oregon. It also would have required many landowners to seek permits for activities that are simply not connected to Oregon’s waterbodies.
